Rental Agreement/Liability Waiver

This Rental Agreement (“Agreement”) is entered into between the customer (“Client”) and The Posh Party Co. for the rental of sleepover party equipment and décor as outlined in the confirmed booking.

1. Rental Items

The Posh Party Co. agrees to rent and deliver the items selected by the Client, which may include:

Teepee tents
Mattresses and bedding
Decorative pillows and rugs
String lights and accessories
Themed décor and props
Optional add-ons (spa kits, balloons, trays, etc.)

All rented items remain the sole property of The Posh Party Co.

2. Rental Period

The standard rental period is 24 hours, unless otherwise agreed upon in writing. Early setup and next-day pickup will be coordinated with the Client in advance.

3. Payment & Cancellation

A deposit of $50 is due upon booking to reserve the event date.
Full payment is due 72 hrs before the scheduled setup.
Cancellations made within 48 hours of the event are non-refundable but may be rescheduled based on availability.

4. Client Responsibilities

The Client agrees to:

Ensure the setup area is clean, smoke-free, and clear of obstacles before delivery.
Supervise children at all times during the rental period.
Prevent food, drink, pets, and rough play near the rental items to avoid damage.

5. Damage & Replacement

The Client is responsible for the care of all rented items. Any lost, stolen, or excessively damaged items will incur a replacement fee as determined by The Posh Party Co. This includes but is not limited to:

Torn or stained fabric
Broken props or lighting
Missing décor items
Items returned smelling of smoke

6. Liability

The Posh Party Co. is not liable for any injuries, allergic reactions, or damages occurring during the use of rental items. A signed Liability Waiver must be submitted prior to the event.

7. Agreement

By signing below, the Client agrees to the terms of this Rental Agreement and acknowledges responsibility for all items during the rental period.

This Liability Waiver and Release of Claims (“Waiver”) is executed by the undersigned in favor of The Posh Party Co., its owners, employees, agents, and affiliates (collectively, “The Posh Party Co.”). By signing this document, you acknowledge and agree to the following terms:

1. Assumption of Risk

I understand that participation in The Posh Party Co.’s sleepover and event services—including but not limited to the use of tents, teepees, decorative items, and party-related equipment—involves certain inherent risks. These may include, but are not limited to, slips, trips, falls, allergic reactions, and other unforeseen incidents. I voluntarily assume all risks associated with participation in the event.

2. Release of Liability

I hereby release and discharge The Posh Party Co. from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or illness that may be sustained by any participant or property during or after the event.

3. Indemnification

I agree to indemnify and hold harmless The Posh Party Co. from and against any claims, damages, losses, and expenses, including legal fees, arising out of or resulting from my participation or the participation of minors under my care.

4. Supervision of Minors

I understand that The Posh Party Co. does not provide supervision of children during the event. I am responsible for ensuring that a responsible adult is present at all times.

5. Condition of Equipment

I agree to return all rented equipment and materials in the condition in which they were received. I accept responsibility for any lost or damaged items and agree to pay the replacement costs as determined by The Posh Party Co.
